Copyright Infringement Policy & Operating Procedures

1. Objective

WISE Wireless complies with the Online Copyright Infringement Liability Limitation Act of 1998 (17 U.S.C. § 512). In line with this Act, WISE Wireless reserves the right to suspend or permanently terminate the internet service of any customer who repeatedly violates copyright law.

2. Policy

In accordance with the Digital Millennium Copyright Act (DMCA), copyright holders may submit formal notifications to WISE Wireless regarding suspected copyright infringement occurring on our network.

When WISE Wireless receives a valid notification of copyright infringement, the following procedure is followed:

  • First Warning: A letter is sent informing the customer of the copyright violation, which is a breach of WISE Wireless’s Acceptable Use Policy (AUP) and Broadband Service Agreement. It warns that continued violations may lead to suspension or termination. (Attachment A)
  • Second Warning: A second notice is sent if a subsequent offense occurs within a 12-month period. It reiterates the violation and consequences. (Attachment B)
  • Final Warning: A third offense within 12 months results in a final warning sent via certified mail. The customer is advised that one more violation may result in account termination. (Attachment C)
  • Termination Notice: A fourth offense in the same 12-month period leads to immediate service termination. A termination letter is sent via certified mail instructing the customer to return all equipment. (Attachment D)

WISE Wireless may also take immediate action without prior notice if a court order or legal requirement compels such action, or if we determine that the activity:

  • Could result in legal action or regulatory penalties against WISE Wireless
  • Compromises the integrity, safety, or performance of our network or systems
  • Interferes with the ability of others to use WISE Wireless services or the internet
  • Harms or damages the reputation of WISE Wireless
  • Presents risk to our company, staff, customers, or agents

3. Record Retention

  • All infringement notices and evidence are retained securely at WISE Wireless headquarters for a minimum of five years.
  • All communications with customers regarding copyright notices are saved in our secure digital records system for at least five years.
  • A database is maintained with account numbers, notification dates, and associated metadata for all copyright infringement reports.

4. Responsibility

WISE Wireless’s Chief Financial Officer (CFO) is designated as our DMCA Agent with the Federal Communications Commission (FCC) and is the primary point of contact for all copyright-related matters. The CFO, with support from the customer service and IT teams, is responsible for managing and enforcing this policy.

5. DMCA Contact Information

WISE Wireless adheres to the DMCA and reserves the right to terminate service to repeat infringers. If a determination is made that a subscriber has violated copyright law through our network, further violations may result in service cancellation.

WISE Wireless does not interfere with legitimate technical systems that protect copyrighted content, within the scope of the DMCA.
